Silence Means Consent

In my country, Paraguay, where the majority of the population is Roman Catholic, we carry deep within our subconscious the belief that sin is not only committed through actions, but also through thoughts, words, deeds, and omissions.

It’s a heavy burden to be Catholic—imagine, one can sin just by thinking! But well, that’s what we inherited from our colonizers, who not only passed down the Spanish language but also this religion. Therefore, an omission can not only be a sin, but also a confirmation of something that goes unchallenged.

In Paraguay, it’s often said that “Silence means consent,” so omitting information instead of lying is almost the same as lying—and also a way of tacitly accepting an affirmation or denial that involves us.

Personally, I believe that if we possess certain information whose omission could lead to error or confusion, it’s equivalent to lying to achieve the same end.

Just this afternoon, I was talking with my mother about a situation that falls into this category of omissions. We have certain information that a new neighbor lacks, and she may end up being scammed by a former neighbor. I wasn’t aware of the situation, and when my mother told me, I immediately asked if she had shared it.

Her response was that she didn’t want to disappoint the new neighbor and didn’t know how to tell her what we know. As for me, I’m firmly convinced that if someone knows something that another person doesn’t—and that ignorance could lead to harm—they should speak up, at least so the affected person can take precautions.

I know many people might think that sharing information that affects others could be mistaken for gossip, but let me clarify: I’m referring to situations where someone tells you something like “I bought the plot from the neighbor on the corner,” and you know very well that the neighbor doesn’t own that land and therefore cannot sell it.

Omissions like that, in my view, are simply immoral and represent serious ethical failures.

For example, this issue of omitting the truth is something real estate agents around the world often do. In fact, it brings to mind urban legends about haunted houses or places where terrible crimes occurred—yet prospective buyers are rarely informed.

Omission should be punishable by law when it can cause harm of any kind to those affected by the lack of information.

It’s not only morally reprehensible—it’s something we should not participate in if we believe in justice, whether divine or human. Because it’s not right. And I’m not referring to “kind-hearted” omissions like white lies—I mean important information whose absence could cause harm to third parties.

El que calla otorga

En mi país, Paraguay , cuya población es de mayoría católica apostólica romana, siempre tendremos en lo más profundo de nuestro subconsciente que el pecado no solo es de acción, sino también de pensamiento, palabra, obra y omisión.

Es una carga pesada ser católico, imaginen que uno puede pecar hasta por pensar! Pero bueno, es lo que tenemos gracias a nuestros colonizadores que además de darnos de herencia la lengua castellana, también nos dejaron esta religión. Por lo tanto, una omisión además de poder ser un pecado también puede ser la confirmación de algo que no se refuta.

Mucho se dice en mi país que "Quien calla, otorga", entonces omitir una información en lugar de mentir, es casi igual que mentir, y también una forma de aceptar tácitamente alguna afirmación o negación que nos involucre.

Particularmente pienso que si tenemos cierta información, cuya omisión puede llevar a error o confusión, es igual que mentir para llegar al mismo fin.

Justo esta tarde, estaba conversando con mi madre de un asunto que cae en esta categoría de las omisiones, porque nosotros tenemos cierta información de la que carece una nueva vecina, la cual posiblemente termine siendo estafada por un ex vecino. Yo no estaba al tanto del asunto, y cuando me lo comentó mi madre, de inmediato le pregunté si se lo contó.

La respuesta de mi madre es que no quiere decepcionarla y no sabe cómo contarle lo que nosotros sabemos. Por mi parte, estoy más que firmemente convencida de que si una persona sabe algo que otra persona no y ésta puede terminar siendo afectada por este desconocimiento, debería contar lo que sabe, al menos para que la persona involucrada pueda tomar recaudos.

Sé que muchos pensarán que eso de ir contando cosas que afectan a otras personas puede confundirse con chismes, pero aclaro, me refiero a ocasiones en las que una persona te está comentando algo a tí, del tipo compré el terreno del vecino de la esquina, y tú sabes bien que el vecino de la esquina no es propietario de ese terreno y por lo tanto no puede venderlo.

Estas omisiones, como la hipótesis anterior, me parecen que sencillamente son inmorales, y representan omisiones graves.

Por ejemplo este asunto de omitir una verdad es algo que normalmente hacen los corredores de bienes raíces de todo el mundo, y de hecho, me viene a la mente las leyendas urbanas de casas embrujadas, lugares en los que se cometieron crímenes terribles, pero de lo que no suelen ser informados los interesados en comprarlas.

La omisión debería estar penada por ley, cuando esa omisión puede ocasionar daño de cualquier índole a quienes esa falta de información pudiera repercutir.

No sólo es moralmente reprochable, es un asunto del que no deberíamos participar si creemos en la justicia sea esta divina o humana porque no está bien, y no me refiero a omisiones del tipo "bondadoso" en el que cae la mentira piadosa, me refiero a información importante cuya falta de conocimiento podría ocasionar daños a terceros.
